Arizona Bankruptcy Courts - Tucson Division

The Arizona Bankruptcy Court for the Tucson Division provides copies of local rules online without charge. Alternatively, the State Bar sells copies of local rules for $10 which are available via first class mail delivery, from the State Bar of Arizona, 111 W. Monroe, Ste. 1800, Phoenix, AZ 85003-1742.

The Tucson Division jurisdiction covers the counties of Pinal, Pima, Santa Cruz, Graham, Cochise, and Green Lee County. In general, a domicile within the county - used as a primary residence - is sufficient for jurisdiction. US citizenship is not required. State citizenship is not required. A debtor who does not live within the borders of the United states but does own property or operate a business within the state may file after 180 days.

The Tucson Division provides examples of petitions, schedules, forms, local rules and official instructions that may be useful when filing. Be aware that instructions provided are general, and are not a substitutive for legal advice which may provided by a qualified attorney. The Code prohibits judges, clerks and personnel to provide debtors with information that may be construed as legal counsel. This provision applies equally to debtors, creditors, and parties in interest. Individual filing pro se may call trustees and inquire about case status. Trustee offices generally explain the basis of all objections filed.
